          ARTICLE 4- GENERAL PROVISIONS<\/span>

          4.1- BUYER declares that he\/she has read and is informed about the basic qualities, sales price and payment method of the product subject to the contract and the preliminary information regarding delivery on the www.zahia.store website and has given the necessary confirmation electronically. 4.2-<\/span>
          The product subject to the contract will be delivered to the BUYER or the person\/institution at the address indicated by the BUYER within the period specified in the preliminary information on the website depending on the distance of the BUYER’s place of residence for each product, provided that it does not exceed the legal 30-day period.<\/span>
          4.3- If the product subject to the contract is to be delivered to a person\/institution other than the BUYER, the SELLER cannot be held responsible if the person\/institution to be delivered does not accept the delivery.<\/span>
          4.4- SELLER is responsible for the delivery of the contractual product in a sound, complete manner, in accordance with the specifications specified in the order and with warranty documents and user manuals, if any.<\/span>
          4.5- In order for the delivery of the contractual product, it is mandatory that the signed copy of this contract be delivered to SELLER and the price be paid with the payment method preferred by BUYER. If the product price is not paid for any reason or is canceled in bank records, SELLER is deemed to be relieved of its obligation to deliver the product.<\/span>
          4.6- If the relevant bank or financial institution does not pay the product price to SELLER due to unauthorized or illegal use of BUYER’s credit card by unauthorized persons not caused by BUYER’s fault after the delivery of the product, the product must be sent to SELLER within 3 days, provided that it has been delivered to BUYER. In this case, shipping expenses belong to BUYER.<\/span>
          4.7- If the SELLER cannot deliver the contracted product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation, the SELLER is obliged to notify the BUYER. In this case, the BUYER may exercise one of the following rights: cancellation of the order, replacement of the contracted product with a similar one, if any, and\/or postponement of the delivery period until the elimination of the impeding condition. If the BUYER cancels the order, the amount paid by the BUYER shall be paid to the BUYER in cash and in a single transaction within 10 days.<\/span>
          4.8- Defective or broken products, whether or not sold with a warranty certificate, may be sent to the SELLER for the necessary repairs under warranty conditions; in this case, the shipping costs shall be covered by the SELLER.<\/span>

          ARTICLE 5- RIGHT OF WITHDRAWAL<\/span>

          The BUYER has the right of withdrawal within 14 days from the delivery of the product subject to the contract to him\/her or to the person\/organization at the address he\/she has indicated. In order to exercise the right of withdrawal, the SELLER must be notified by fax, email or telephone within this period and the product must not have been used within the framework of the provisions of Article 6. In the event of exercise of this right, the return of the original invoice and a copy of the cargo delivery report stating that the product delivered to a 3rd party or the BUYER was sent to the SELLER are mandatory. The product price will be refunded to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded. The cargo cost of the product returned due to the right of withdrawal will be covered by the BUYER.<\/span>

          ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED<\/span>

          The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that deteriorate quickly or have expired. The use of the right of withdrawal in the following products is subject to the condition that the packaging of the product is unopened, undamaged and the product is unused.<\/span>

          – Portable Computer (No returns will be accepted after the original operating system is installed.)<\/span>
          – All kinds of software and programs<\/span>
          – DVD, VCD, CD and cassettes<\/span>

          ARTICLE 7 – AUTHORIZED COURT<\/span>

          In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts at the place of residence of the BUYER or SELLER are authorized up to the value declared by the Ministry of Industry and Trade.<\/span>

          4.1- ALICI, www.zahia.store internet sitesinde s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn temel nitelikleri, sat\u0131\u015f fiyat\u0131 ve \u00f6deme \u015fekli ile teslimata ili\u015fkin \u00f6n bilgileri okuyup bilgi sahibi oldu\u011funu ve elektronik ortamda gerekli teyidi verdi\u011fini beyan eder.
          4.2- S\u00f6zle\u015fme konusu \u00fcr\u00fcn, yasal 30 g\u00fcnl\u00fck s\u00fcreyi a\u015fmamak ko\u015fulu ile her bir \u00fcr\u00fcn i\u00e7in ALICI\u2019n\u0131n yerle\u015fim yerinin uzakl\u0131\u011f\u0131na ba\u011fl\u0131 olarak internet sitesinde \u00f6n bilgiler i\u00e7inde a\u00e7\u0131klanan s\u00fcre i\u00e7inde ALICI veya g\u00f6sterdi\u011fi adresteki ki\u015fi\/kurulu\u015fa teslim edilir.
          4.3- S\u00f6zle\u015fme konusu \u00fcr\u00fcn, ALICI\u2019dan ba\u015fka bir ki\u015fi\/kurulu\u015fa teslim edilecek ise, teslim edilecek ki\u015fi\/kurulu\u015fun teslimat\u0131 kabul etmemesininden SATICI sorumlu tutulamaz.
          4.4- SATICI, s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn sa\u011flam, eksiksiz, sipari\u015fte belirtilen niteliklere uygun ve varsa garanti belgeleri ve kullan\u0131m klavuzlar\u0131 ile teslim edilmesinden sorumludur.
          4.5- S\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn teslimat\u0131 i\u00e7in i\u015fbu s\u00f6zle\u015fmenin imzal\u0131 n\u00fcshas\u0131n\u0131n SATICI\u2019ya ula\u015ft\u0131r\u0131lm\u0131\u015f olmas\u0131 ve bedelinin ALICI\u2019n\u0131n tercih etti\u011fi \u00f6deme \u015fekli ile \u00f6denmi\u015f olmas\u0131 \u015fartt\u0131r. Herhangi bir nedenle \u00fcr\u00fcn bedeli \u00f6denmez veya banka kay\u0131tlar\u0131nda iptal edilir ise, SATICI \u00fcr\u00fcn\u00fcn teslimi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden kurtulmu\u015f kabul edilir.
          4.6- \u00dcr\u00fcn\u00fcn tesliminden sonra ALICI\u2019ya ait kredi kart\u0131n\u0131n ALICI\u2019n\u0131n kusurundan kaynaklanmayan bir \u015fekilde yetkisiz ki\u015filerce haks\u0131z veya hukuka ayk\u0131r\u0131 olarak kullan\u0131lmas\u0131 nedeni ile ilgili banka veya finans kurulu\u015fun \u00fcr\u00fcn bedelini SATICI\u2019ya \u00f6dememesi halinde, ALICI\u2019n\u0131n kendisine teslim edilmi\u015f olmas\u0131 kayd\u0131yla \u00fcr\u00fcn\u00fcn 3 g\u00fcn i\u00e7inde SATICI\u2019ya g\u00f6nderilmesi zorunludur. Bu takdirde nakliye giderleri ALICI\u2019ya aittir.
          4.7- SATICI m\u00fccbir sebepler veya nakliyeyi engelleyen hava muhalefeti, ula\u015f\u0131m\u0131n kesilmesi gibi ola\u011fan\u00fcst\u00fc durumlar nedeni ile s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fc s\u00fcresi i\u00e7inde teslim edemez ise, durumu ALICI\u2019ya bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Bu takdirde ALICI sipari\u015fin iptal edilmesini, s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn varsa emsali ile de\u011fi\u015ftirilmesini, ve\/veya teslimat s\u00fcresinin engelleyici durumun ortadan kalkmas\u0131na kadar ertelenmesi haklar\u0131ndan birini kullanabilir. ALICI\u2019n\u0131n sipari\u015fi iptal etmesi halinde \u00f6dedi\u011fi tutar 10 g\u00fcn i\u00e7inde kendisine nakten ve defaten \u00f6denir.
          4.8- Garanti belgesi ile sat\u0131lan \u00fcr\u00fcnlerden olan veya olmayan \u00fcr\u00fcnlerin ar\u0131zal\u0131 veya bozuk olanlar, garanti \u015fartlar\u0131 i\u00e7inde gerekli onar\u0131m\u0131n yap\u0131lmas\u0131 i\u00e7in SATICI\u2019ya g\u00f6nderilebilir, bu takdirde kargo giderleri SATICI taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r.<\/p>

          MADDE 5- CAYMA HAKKI<\/p>

          ALICI, s\u00f6zle\u015fme konusu \u00fcr\u00fcr\u00fcn\u00fcn kendisine veya g\u00f6sterdi\u011fi adresteki ki\u015fi\/kurulu\u015fa tesliminden itibaren 14 g\u00fcn i\u00e7inde cayma hakk\u0131na sahiptir. Cayma hakk\u0131n\u0131n kullan\u0131lmas\u0131 i\u00e7in bu s\u00fcre i\u00e7inde SATICI\u2019ya faks, email veya telefon ile bildirimde bulunulmas\u0131 ve \u00fcr\u00fcn\u00fcn 6. madde h\u00fck\u00fcmleri \u00e7ercevesinde kullan\u0131lmam\u0131\u015f olmas\u0131 \u015fartt\u0131r. Bu hakk\u0131n kullan\u0131lmas\u0131 halinde, 3. ki\u015fiye veya ALICI\u2019ya teslim edilen \u00fcr\u00fcn\u00fcn SATICI\u2019ya g\u00f6nderildi\u011fine ili\u015fkin kargo teslim tutana\u011f\u0131 \u00f6rne\u011fi ile fatura asl\u0131n\u0131n iadesi zorunludur. Bu belgelerin ula\u015fmas\u0131n\u0131 takip eden 7 g\u00fcn i\u00e7inde \u00fcr\u00fcn bedeli ALICI\u2019ya iade edilir.
